Additional Insured: What is It?

United States Swimming Member Clubs have general liability insurance through the U.S. Swimming Insurance Program as Additional Insureds. What is the definition of an additional insured?

Entity outside of the Named Insured; their relationship to Named Insured gives them an insurable interest for claims arising out of the negligence of the Named Insured; entitled to defense and indemnity (if policy limits not exhausted by Named Insured); no responsibility for premium payment.

On the U.S. Swimming policy, Named Insureds include:

1. United States Swimming

2. U.S. Swimming's Local Swimming Committees

Additional Named Insureds are identified as:

1. United States Swimming, Inc. Member Clubs for Insured Activities

2. Any Member of United States Swimming., or volunteer, while acting on behalf of and with the approval of the Board of Directors of United States Swimming, Inc.

Coverage is provided for the Member Clubs based on their being "a member in good standing" with USS. This required that the Member Club be in compliance with all USS Rules and Regulations, including the provisions of Articles 501.7.2 and 602.1.1A as follows:

Article 501.7.2 All coaches of USS clubs, including Seasonal Clubs, shall join the Corporation as coach members and shall satisfactorily complete safety training required by the Corporation.

Article 602.1.1A Clubs which have joined and are in good standing as members of the LSC and United States Swimming, have athletes and coaches, all of whom are members in good standing of the LSC and United States Swimming, and whose coaches all have satisfactorily completed safety training required by United States Swimming.

Under the heading of Additional Named Insureds, the following statement will be included:

The Member Club must be a USS member in good standing which means that all athletes and coaches must be USS members.

Under the heading of What Activities Are Insured, the following clarifications will be added:

Item 2 is changed to read: Swimming practice where all participants are members of U.S. Swimming, Inc. The practice must be held under the direct supervision of USS Member Club Coaches.

Item 3 is changed to read: Learn to Swim Programs where all participants are members of U.S. Swimming. Learn to Swim Programs must be held under the direct supervision of USS Member Club Coaches.

Item 4 is changed to read: Swimming tryouts under direct supervision of USS Member Club Coaches.
